PATENTS

Patents can be very valuable because they entitle their owners to exclude others from making, using or selling the covered inventions. Patents can provide the safety net necessary for an aggressive business investment in technology. They can protect market share and profit margins. However, patents in the hands of competitors can severely restrict a company's profitability and growth.

Sheldon Mak Rose & Anderson assists clients in:

The firm engages in all phases of patent procurement, including application preparation, prosecution, and appellate proceedings in the U.S. and abroad, through filings under the Patent Cooperation Treaty (PCT), in the European Patent Office (EPO) and nationally.

We provide patent related services in all technologies, including for example: biotechnology, chemistry, chemical engineering, digital imaging and imaging science, computer software, electronics, optics, mechanical engineering, and materials sciences. Patents we have obtained for our clients have successfully protected hundreds of millions of dollars in sales.

Our clients are encouraged to consider patent protection for their significant commercial products and processes.  Our clients are also advised, however, that not every innovation merits a patent application. We work closely with clients to evaluate the relative value of each potential patent investment, always considering (1) the chances of obtaining patent protection, (2) the potential scope of the resulting patent claims, (3) cost of the patenting process, and (4) the economic advantages from the resulting patent.

We also assist clients in the licensing of their patent rights, and securing rights in the patents of others to realize profit. Clients work with the firm's lawyers to understand the economic value of the patents and to negotiate for the most favorable result whether licensing in or out.

It is also important to remain aware of the patent rights of competitors. Few events can ruin profitability faster than losing a patent infringement suit. We provide our extensive experience in patent law to our clients in an effort to avoid infringement liability. We can and have aggressively challenged invalid patent claims. At the same time we caution our clients to respect valid and enforceable patents. We are proud to say that no client that has followed our advice has ever been sued successfully for patent infringement.

Among our clients who have put our expertise in patents to their uses are such well-known companies as Jet Propulsion Laboratories, Beckman Instruments, Raychem, Nik Software, Cal Spas and Southern California Edison. The firm's achievements are recognized by practicing professionals as well. A treatise written by the firm, How to Write a Patent Application, published by the Practicing Law Institute, is recognized by professionals throughout the world as one of the best in the genre.
